Never again fines, never again having to follow laws – District Administrator Götz Ulrich (CDU) clears the way

Mail arrived from the District Administrator’s office with a bundle of letters, which warms the heart on these gray autumn days. The beloved District Administrator of Burgenlandkreis, Götz Ulrich, responded to my inquiries during the citizens’ question time at the last district council meeting. Among them was the response to a reminder I had raised multiple times.

Diligent readers of Bürgerstimme will surely remember that the highly esteemed Götz Ulrich prohibited me from recording a video of a district council committee meeting in October 2024. At the time, he claimed he was obliged to follow legal requirements and referred to the council’s rules of procedure, which stated that such recordings must be registered in advance. However, registering is not the same as requesting, and it certainly does not require permission for such recordings. Registration merely informs the authorities that filming is intended or will take place.

For the highly respected District Administrator Götz Ulrich, the lack of registration was reason enough to insist on the immediate execution of his verbally issued administrative act. He stated that it could later be determined whether this decision was lawful. He also noted that I could take legal action. He was aware, however, that this would be meaningless once the meeting was over – he confirmed this.

A few days after this meeting, I filed an objection and received in January 2025 a letter from the District Administrator’s aides in the Legal and Regulatory Office of Burgenlandkreis, presenting their legal opinion. There, too, it was mentioned that I could file a lawsuit. Furthermore, the matter was considered resolved due to the passage of time, since the meeting was over. But what the district’s minions conveniently omitted in their pursuit of capturing the naive: the matter is by no means resolved by the passage of time. An administrative act must remain verifiable afterward. If the District Administrator’s actions set a precedent, it would open the door to arbitrariness, allowing him to ban anything he dislikes at will and later claim it has resolved itself over time.

My repeated reminders to uphold the law

In recent months, I repeatedly reminded during the district council’s citizens’ question time that the much-loved District Administrator Götz Ulrich was neglecting certain legal obligations. For instance, administrative procedure law stipulates that a verbally issued administrative act must be formalized in writing if there is a legitimate interest. My written objection should have made this abundantly clear.

Immediate execution must also be particularly justified – either due to an imminent danger that must be averted or because of a significant public interest. A video recording certainly does not pose a danger. Therefore, the Christian-Democratic District Administrator Ulrich would need to explain why the public interest in not recording outweighs the interest in recording.

Such decisions must, of course, also take into account press freedom and other high legal principles, which cannot simply be overridden by the district council’s rules of procedure.

A few months ago, the revered District Administrator had his aides in the Legal and Regulatory Office send me their letter for the second time. And now, at the beginning of November – bringing tears of emotion to my eyes – I received this letter for the third time. Along with some personally warm lines addressed to me, stating that this letter had already been sent twice. Still, no written form of his administrative act, no justification for immediate execution, and no decision on my objection.

The District Administrator frees us from the burden of having to follow laws!

Of course, one could be outraged at how the chief administrative officer continues to knowingly and willfully – that is, intentionally – disregard laws. A District Administrator who once swore an oath of office to uphold the Basic Law and the state constitution, to observe all laws, to exercise his office diligently, and to serve as a role model in the rule of law. One who promised to uphold law, not power. This duty exists even before a court confirms it. Simply knowingly ignoring legal provisions or judicial duties can constitute a breach of the oath of office.

Some may remember the mayor of Teuchern, who intended to speak at a demonstration against the facility-based vaccination mandate. Immediately, the municipal supervision was dispatched to examine the mayor’s loyalty to the constitution. Even Rüdiger Erben (SPD), a state parliament member and district council member of Burgenlandkreis, addressed this in the Saxony-Anhalt state parliament, as it should not be acceptable for a mayor to criticize or deviate from the official line.

Yet in the case of the submissively beloved District Administrator Götz Ulrich, municipal oversight has so far seen no reason to subject him to similar scrutiny. One might think that if the District Administrator continues to ignore so many legal provisions in this matter, he would do the same in other cases, right?

And then there are also the members of the district council, particularly those parties who repeatedly claim to be the only democrats. Their task is also to monitor the District Administrator’s actions, censure him, and suggest his removal if warranted. But so far, there has been no protest. No criticism. No: “Come on, District Administrator, Götz little one, shouldn’t you handle this differently? Don’t you think it’s a bit too obvious how you refuse to follow laws?”

Remember the demonstrations, especially in Bad Bibra, where a distinguished cross-party group, including state parliament members, joined the great District Administrator to demonstrate against the far right and for “our democracy.” Yet even there, his legal violations do not seem to cause discontent. Could it be that even they support the District Administrator so he can continue acting unlawfully?

Illuminatio et Exsultatio

Since so many who have sworn oaths to uphold law and justice have no problem with the chief administrative officer, the deeply beloved District Administrator Götz Ulrich, disregarding law and order, it can surely be legally inferred that laws and legal requirements henceforth no longer need to be followed by citizens, the sovereign. And that truly warms the heart, because it makes life so much easier.

Fines for illegal parking or speeding – no one needs to pay anymore, since the tributaries of the District Administrator in the Legal and Regulatory Office have no problem with the chief administrative officer’s unlawful actions.

But why stop at regulatory offenses? Paying taxes just because some mundane law says so? Following any other regulations? Why? The great, unparalleled role model Götz the Ulrich doesn’t either. If the chief administrative officer doesn’t have to follow laws, it surely cannot be said that the sovereign, the citizen, who stands above the District Administrator in a true democracy, must comply with laws. After all, the District Administrator is the employee of the sovereign, the citizen. Equal law for all, right?

I am overjoyed. And I will probably express my deepest gratitude to the holy idol, Ulrich, at the next district council meeting. Finally, we are all free from the burden of following rules, regulations, ordinances, and laws. I think we should all now scatter flowers along his path and, when the time of his holiness permits, kiss his feet, right? We should immediately begin building monuments for him and naming newborns after him.

And you citizens, you sovereigns, spread this joyful news far beyond the borders of Burgenlandkreis, so that in other parts of this best, most lawful, and most democratic Germany ever, people will know that laws are now just beautiful words of legal poetry, but otherwise completely meaningless.

A Christian-Democratic Hallelujah and Amen!
