CDU, SPD, Greens, FDP hinder the disabled - Big anniversary! DAK still hasn't processed the objection after one yearOne should celebrate the anniversaries as they fall, as the saying goes – or something like that. These days marks the anniversary of the DAK's rejection of the disability-accessible vehicle conversion. 
These are once again a few lines on a personal matter. I had already reported some time ago that, in order to be able to take our daughter in the car, we had submitted a prescription for a vehicle conversion to the health insurance company DAK. Specifically, a seat in the second row was to be electrically extendable so that the transfer from the wheelchair into the car could be managed without effort. In addition, a ramp was to be installed at the rear in order to be able to take the electric wheelchair, which weighs a good 150 kg. Since the previous vehicle had celebrated its 10th birthday and the installation/conversion was to be used for a long time, a new vehicle was purchased, which was scraped together from what we could save from our mouths. The health insurance company DAK rejected the conversion at the end of July 2025 on the grounds that people with disabilities do not need this. According to the health insurance company's view, the basic needs of a human being (whether with or without a disability) amount merely to a roof over one's head, a bathroom with a toilet for hygiene, a telephone for communication, television reception, and the possibility of shopping in the immediate vicinity of the home and getting some fresh air now and then. A human being needs nothing more – whether with or without a disability. An objection was filed against this, because quite a bit has changed in case law. People with disabilities are no longer merely to be somehow warehoused; rather, these people have for some time now had a right to self-determination, which includes the freedom to leave the immediate vicinity of the home, and a right to participation. Moreover, it was primarily about securing therapy and doctor appointments. The health insurance company DAK initially did not really want to engage with this and wanted to know how many trips to therapies and doctors occur per year. Because it could be that using a transport service is more cost-effective. That such a service can only be hired for medical purposes and that even this is always associated with a certain bureaucratic and time-consuming effort, because one has to obtain transport vouchers from the doctor and contact transport services in order to arrange the appointments, seems to be of no significance to the health insurance companies. Going somewhere spontaneously, spontaneously to the doctor because of an illness – that then simply doesn't work so easily. The information that the health insurance company wanted was transmitted in October 2025, and then there was silence in the forest. In December 2025, a telephone inquiry was made about the current status. On the phone it was said that the objection was with the objections committee and that the service staff of the DAK had no insight into the documents as to what the concrete status of things was. One had to have patience. A message would come. Of course, no message came. Repeated telephone inquiries as well, such as 3 times in the past week at the end of July 2026, led to no newer information. The two ladies of the objections department would call back. This, however, happened just as little as it had not happened in the past months either. Every time I lift my daughter into the car in order to drive to doctor or therapy appointments, the intervertebral discs and the knees already begin to strike up the melody of “Play Me the Song of Death.” Days of back pain are the result. The physiotherapist urges caution, because new appointments only become free when current patients have been visited by the Grim Reaper. Of course, this was also repeatedly told to the case workers on the phone. More than “We're sorry” these could not reply, and they said that they would pass it on to the two ladies of the objections department. There is no direct extension to be able to speak with the ladies themselves. The ladies are accordingly not to be disturbed in their work of playing for time. In the meantime, a complaint to the board was also submitted. As expected, there was likewise no reaction whatsoever to that. Criminal complaint for failure to render assistanceThe consideration now is to file a criminal complaint for failure to render assistance in conjunction with negligent bodily injury and coercion (endangering one's own health) against the two ladies of the objections department and the board of the DAK.Under administrative law, going to the social court would certainly have priority. The first thing would be an action for failure to act, so that the objection is finally processed. But this lawsuit is only about the processing of the objection and not about the approval of the vehicle conversion itself. The health insurance company can therefore also reject the objection, because the disabled are simply too expensive and don't need all that anyway. A lawsuit would then seamlessly follow in order to get the vehicle conversion financed. That would be wonderful for the health insurance company, because it can then lean back and wait for the outcome of the proceedings. Such proceedings can easily drag on for many years. Should the social court grant the conversion, the health insurance company can go to the next instance, the state social court. Should the social court decide in favor of the health insurance company, we would have to go to the state social court. And that takes another certain amount of time. Depending on how well-disposed the state social court is toward the health insurance company, the proceedings can also simply be left lying there for the time being. Of course, one can file a complaint of inactivity against the judges. But this not infrequently leads to a very quick dismissal of the lawsuit without an oral hearing, even if one had requested an oral hearing. As the affected party, one can of course lodge legal remedies against that, which then again require a lot of time for processing. The courts are also absolute masters at playing for time. Recently a letter came from the social court regarding a still pending procedure on the topic of data protection violation by the social welfare office of the Burgenlandkreis. This was separated from the then lawsuit during the oral hearing in September 2022 and made into a separate procedure. And before one knows it, not even 4 years later, the social court then finally wants to continue with this procedure. That's how fast it goes. One can really get dizzy from that. Whereby I suspect in this procedure that the statute of limitations was to be waited out. Even if it is judicially established that the employees of the social welfare office of the Burgenlandkreis had violated data protection, that would then be harmless. That's then done and dusted! There are no consequences. Social courts are, from experience, very diligent about protecting the social authorities from these affected persons. I suspect that the reasoning of the health insurance company with which it rejected the conversion does not hold water and that it is after all more cost-effective to finance the vehicle conversion, even if this will cost a good 15,000 euros. But in times of tight budgets that is quite a pile of money that the health insurance company obviously does not want to spend. So time is being played for and my health is being endangered as well. There was something not so long ago, wasn't there, when it was said that health had the highest priority? Money played absolutely no role then. Oh, I forgot, that was about a cold virus, about a runny nose. Everything imaginable had to be done so that not so many people would catch it. That probably only cost a few trillion. Of course that is not to be compared with a vehicle conversion. Why are the governing parties CDU, SPD, Greens, FDP to blame for this situation?The government loyalists, who do not shy away from calling me a Nazi, brown asshole and similar things, will now probably cry out again and explain that the leaders so beloved by many cannot help it at all that the health insurance company is playing for time like this.However, the leaders so beloved by many are responsible for the conditions in the country. Including that the health insurance companies are currently struggling with deficits. The leaders so beloved by many could also change the laws in the interest of those affected. There is, for example, the fiction of approval, which states that a benefit is deemed approved if the health insurance company does not stir within a time window. However, this only applies to small things. For a vehicle conversion this does not apply so far. The leaders so beloved by many could therefore adapt the laws accordingly. Then we could already have arranged the conversion and sent the invoice to the health insurance companies. But the leaders so beloved by many simply have other priorities. Armament, war, climate madness, subsidies for countries like India and China, deindustrialization etc. – billions upon billions. People with disabilities, their rights and their relatives – completely irrelevant. Let their relatives strain their backs and eventually become care cases themselves. Health protection has its limits, right? Yes, you government loyalists, you may now get upset again about me and my criticism and scatter the usual designations about me on the net. Someone who fights for his child with a disability and thereby fights for people with disabilities in general can only be a Nazi and brown asshole, right? And besides, I am myself to blame if offices, authorities and institutions act like this. A good, submissive citizen who exercises no criticism would certainly already have received an answer. Albeit only a rejection, but an answer with which he is kindly to content himself and somehow come to terms with his fate. I already see the comments that under an AfD government it would become worse for people with disabilities. Only: What is supposed to become worse? Now the health insurance companies and courts are playing for time and de facto give those affected the middle finger every time. So what is supposed to become worse that is not already bad, even though the laws actually prescribe something else? The government loyalists can, however, also show their allegedly social side and use the bank details given below. The conversion costs approximately 15,000 euros. Don't be cheap. Hurry up. My back pain is increasing. Besides, the health insurance company then no longer has to be bothered because of this person with a disability. You will then have paid that out of solidarity toward the health insurance company. Whereby I assume that especially from the diversity proclaimers, who are always so keen on this self-determination, nothing will come.
