Attack by the Anti-Democracy and Non-Transparency Movement in the Burgenlandkreis District Council Successfully Repelled

Yes, they still exist – or rather continue to exist – the Anti-Democracy and Non-Transparency Movement in Burgenlandkreis. However, I was able to successfully fend off an attack by this movement.

The Structural Change Committee of the district council had called a meeting to once again discuss structural change—a topic that affects everyone in the eastern part of the district to some extent. On the agenda was, among other things, the “Green District Heating” project in Hohenmölsen. This exciting project aims to switch district heating from lignite to a “green” variant. Since I live in the quaint town of Hohenmölsen, I thought: I’ll go there and record it on video—for both the current world and posterity.

Exemplarily, I arrived about 15 minutes before the meeting started in Consultation Room 1.301 in House 1 of the district office in Naumburg. Already present were “Mr. Administration” (as the nameplate in front of him read) and Andy Haugk, Mayor of Hohenmölsen and Chairman of the District Council. I asked if the big action was about to happen. They asked if I wanted to film, since I had my equipment with me. I said yes.

Mr. Administration said that I should have registered this. I replied that I had already done so in November of last year. Mr. Administration disagreed, claiming that I had only registered video recording for district council meetings and the district executive committee meetings. I contradicted him: I had also registered video recording for all district council committee meetings. Mr. Administration insisted this was not the case. This was a meeting of the Structural Change Committee, and for that, I had not submitted a registration. Filming was therefore not permitted, as such a recording would have had to be registered three hours in advance.

“District Executive Committee” or “District Council Committee.” Four letters that make all the difference—for the comrades in the Anti-Democracy and Non-Transparency Movement. That’s how petty these guys are.

I filed an objection with Mr. Administration and referred to the paragraph in the Administrative Court Rules, which states that an objection has a suspensive effect. Andy Haugk joined the conversation and said, in essence, that one should not present administrative rules to Mr. Administration, who is a staff member. Furthermore, there is the district council’s rules of procedure, which had been amended so that registration must be submitted at least three hours in advance. Before the amendment, this deadline did not exist; back then, it only stated that registration had to be done before the start of the meeting.

It should be noted that this was merely a registration—not a request requiring approval, but simply an information to the district council or the respective committee chair that filming would take place.

I asked what the problem was with recording this Structural Change Committee meeting. I received no answer. Andy Haugk referred to the rules of procedure that had to be followed. My objection that the rules might not be entirely legally correct was not up for discussion. I was told to wait for the chair of the Structural Change Committee before setting up my cameras. She had to make the decision. Mr. Administration wanted to check the email again to see what I had registered in November of last year.

Then she finally arrived, the chairwoman, Ms. Elke Simon-Kuch (CDU), and said I could sit in the guest area (four chairs) and take notes. I explained that the Local Government Act explicitly allows video recording. Everything else is governed by the rules of procedure. I emphasized that I did not want any quibbling or hair-splitting.

Ms. Simon-Kuch waited for Mr. Administration to return. And lo and behold – suddenly it was fine. Apparently, they had indeed read that I had registered recordings of the district council committee meetings and not just the executive committee meetings.

It is always astonishing how eager the members of the Anti-Democracy and Non-Transparency Movement in the district council are to prevent such recordings whenever possible.

The highlight of the meeting was that two members of the Citizens’ Advisory Board for Structural Change were invited to introduce this board. Ms. Simon-Kuch asked how the advisory board could be supported to provide more transparency for the citizens.

Yes, there is a certain cognitive dissonance here: the same chairwoman would have prohibited a video recording if registration had been late or phrased incorrectly, yet simultaneously asks how more transparency for citizens can be ensured.

Another point: I would have liked to ask a question about “Green District Heating.” However, Chairwoman Elke Simon-Kuch (CDU) did not allow it. I suspect for reasons of citizen participation, co-determination, and certainly also democracy. She essentially said that the citizen affected by structural change may watch and listen to what the district council members discuss. Asking questions is not allowed—at least not on the topic of structural change. In district council committee meetings on structural change, there isn’t even a citizens’ question period. Probably also for reasons of citizen participation, co-determination, and democracy, right?

Be that as it may: once again, I was able to fend off this attack by the Anti-Democracy and Non-Transparency Movement to create transparency. Perhaps it was also thanks to my work attire—a T-shirt that read: “DICTATORSHIP DELEGITIMIZER.” 😉
