Which square should be renamed to Richter-Christian-Dettmar-Platz?

Someday, there will be a public square in this country bearing the following name: Richter Christian Dettmar.

Someday, there will be a public square in this country bearing the following name: Richter Christian Dettmar. A plaque there will remind people that there was a judge who, out of necessity, tried to protect the well-being of children in this country. It will state that at the time, children were forced to observe distancing, wear masks, undergo testing, and more, even though there was no medical necessity for these measures — and the relevant authorities and experts knew this.

It will also state that these epidemiological facts were known to the RKI (Robert Koch Institute) since February 2020 and could be considered internationally established by April 2020. The paramount protection of child welfare, which is federal law, therefore should not have been pursued through infection control measures, but rather through judges who should have stopped the purely politically motivated COVID measures. These measures were, in fact, the real threat to the physical and mental health of children and adolescents.

Dependent public prosecutors, however, have continued to turn a blind eye to the fact that educators, associations, politicians, doctors, and parents, manipulated through fearmongering, almost entirely failed to stand up for children. It was the political class that used children to induce a state of “shock paralysis” in the population to enforce obedience and conformity. A historical breach of taboo!

It should have been the task of the judiciary to investigate this clearly evident situation in a factual and objective manner. This would have required, on one hand, the competence to resist being frightened by propaganda, and on the other, the courage to call out the insane hygiene policies. But considering the mass-psychological dynamics, this was not to be expected — especially in highly educated circles.

Yet Judge Christian Dettmar did what every single judge dealing with the proportionality of the pandemic policies should have done: consult independent experts and assess the proportionality based on facts. With regard to children, it was an easy task, because all measures aimed at children and adolescents were neither medically necessary, nor ethically justifiable, nor compatible with the inviolability of their dignity enshrined in the German constitution.

Christian Dettmar's conviction, however, does not concern the proportionality of the COVID measures, but rather judicial perversion of justice. For clarification, a passage from Judge Matthias Guericke(1): "The defendant was found guilty of perversion of justice because he 'disregarded judicial independence out of improper motives' and conducted the proceedings 'precisely because of his bias and prejudice' (Judgment, p. 125). The perversion of justice was thus seen in the fact that Judge Dettmar conducted the proceedings in a kind of 'state of bias.' According to the Regional Court’s interpretation, conduct such as the selection of experts was not itself considered perversion of justice, but was instead used as evidence of bias."

Further: "Lack of neutrality and bias can certainly lead to specific procedural violations. But if a judge neither violates procedural rules nor substantive law, a lack of neutrality can never constitute perversion of justice. In the end, only concrete legal violations matter, because criminal law only sanctions external behavior, not internal attitudes. Lawful actions carried out with the 'wrong' internal attitude remain lawful."

For years, judges have wrongly treated the RKI as an objective expert and repeatedly made decisions against the best interests of children (see the Federal Constitutional Court ruling on school closures). In that sense, they themselves were biased or caught in the system and allowed blatant injustice toward children and adolescents to occur — even legally legitimizing it. They themselves wore medically pointless masks for years. Meanwhile, the man who pointed out this egregious misconduct is now being stripped of his judicial office and all his pension rights under questionable reasoning. Additionally, he receives a suspended prison sentence.

But millions of people in this country know what this trial is really about and who was wronged. The justice system has betrayed the children of this country and failed to protect them from an authoritarian-acting state. It has completely failed. Children and adolescents suffered massive and in some cases irreversible harm as a result. Judge Dettmar, in his "Weimar Ruling", provided the factual basis for all judges and prosecutors in this country, making clear that the COVID measures against children and adolescents were unjust. But the responsible prosecutors remained silent.

It is therefore logical that Dettmar must now be harshly punished, to humiliate the bearer of the message of systemic failure. But the message is now public and well known. It will grow louder and gain more support in the population, and in the coming years more and more people will understand who was wronged during the COVID years — and who tried to stop that injustice.

Then, someday, this square in Weimar will exist, and people will lay flowers there daily, silently remembering how a state endangered and harmed the well-being of children — and how only one judge had the courage, in a time of crisis, to protect children and adolescents.

His defense lawyer, Strate, stated: "Everyone can decide for themselves whether the artistic half-light in which both the Regional Court of Erfurt and the 2nd Senate of the Federal Court of Justice have cloaked the accusation of perversion of justice against Mr. Dettmar has been illuminated by the constitutional complaint. Everyone may judge for themselves whether this is a case of lawyer error or whether the decision of the 3rd Chamber of the Second Senate is a concession to the political context of its ruling. The measured voice of the Federal Constitutional Court was missing in 2021 during the bureaucratic handling of the pandemic. It is still missing today."
