The Arrogance of the State – More and More Entrepreneurs Contacted for Review of Corona AidFive years after the start of the COVID-19 pandemic, a new wave of government control is sweeping over small businesses – this time not in the form of aid, but in the form of potential repayment demands. ![]() In Saxony-Anhalt, numerous recipients of emergency COVID-19 aid are currently being contacted by the Saxony-Anhalt Investment Bank. The subject: a review of the "appropriate use" of the aid funds. What was once marketed as quick and unbureaucratic support is now turning into a legal and financial burden for many of those affected. One entrepreneur reports that he is now required to provide a detailed statement of use for the months of May to June 2020 – via an online portal that, at times, was not even accessible due to maintenance. Frustration is high. David vs. Goliath: Small Businesses Targeted, Scammers GoneCriticism is particularly loud from small craft businesses. While they are now combing through old records and laboriously compiling documents years later, dubious companies that fraudulently applied for aid are long gone – many have dissolved, disappeared, or are simply untraceable. It's a slap in the face to those who applied for aid honestly and out of existential need back then.That this review is taking place with such a delay is viewed by many affected as a farce and an outrage. At the time, the media proudly reported that €149 million in Corona aid had been paid out in Saxony-Anhalt. Now, a bureaucratic boomerang threatens. Repayment? Economic End for Many?The suspicion is obvious: what was intended as state rescue during the crisis could now ruin exactly those who are most vulnerable. If repayments are indeed demanded, many small entrepreneurs will be unable to cope. The Corona period has left deep scars; economically, many have never truly recovered.Without the aid, some entrepreneurs now say, it might have been over faster and more honestly. Instead, a slow bureaucratic death looms – through repayments, interest claims, and perhaps even criminal consequences. The State Holds All the Cards – Legal ImbalanceAnother aspect causing discontent: the obvious imbalance of power between the state and its citizens. While entrepreneurs and citizens often have only 14 or 30 days to file an objection to administrative decisions, authorities (such as the tax office) can revise decisions retroactively for up to ten years – even if they have already become legally binding.The political justification: to ensure “legal certainty.” But in practice, this supposed certainty means that even a possibly unlawful administrative decision remains in effect if no timely objection is filed. This one-sidedness is increasingly perceived as unjust. Where Is the Political Correction?The logical question arises: why don't elected representatives change this imbalance? The answer is as simple as it is sobering: because they don't want to. Yet laws could absolutely be amended to establish real equality of arms between citizens and the state. But so far, there is a lack of political will.Subsidy Fraud? The Next Blow LoomsThe situation becomes particularly explosive when, after a review, not only repayment is demanded, but also criminal consequences threaten. According to Section 264 of the German Criminal Code, even the *attempt* of subsidy fraud is punishable. Whether and how such cases are prosecuted ultimately depends on whether the Investment Bank files a complaint and whether prosecutors pursue it.Politically Intended Collapse? – Small Businesses as Collateral Damage of a Questionable Strategy?Thanks to the efforts of numerous committed actors, journalists, and critical experts – as well as the publication of internal documents and parliamentary inquiries – it has become increasingly clear: the measures during the Corona period – from lockdowns to contact bans and business restrictions – were politically intended and deliberately accepted. The economic consequences for small businesses and the self-employed were either underestimated from the beginning or simply ignored. In view of the strict implementation and selective support policies, the impression is growing that politics was deliberately steering toward economic disruption – one in which large corporations benefit while smaller market players are pushed out.
